Some are so profoundly problematic they become taboo, among them euthanasia. That being said, this article aims to analyze the enforcement of euthanasia from a legal perspective and its correlation with the fundamental guarantees. Therefore, a bibliographical research was conducted with a deductive approach, making use of books and scientific papers with legal basis on the constitutional norms. Ultimately, regarding euthanasia, the Brazilian legislation finds itself in a limbo not even its fellow Latin American countries are facing. It must legally encompass euthanasia and more efficiently contemplate the humanitarian aspect of this procedure.
