RETEXTUALIZE, CONTEXTUALIZE, (RE) CONTEXTUALIZE - THE CO-PRODUCTION OF LEGAL DISCOURSES INVOLVED IN STORIES OF FEMALE OFFENDERS WHO SEEK HOME ARREST INSTEAD OF COERCIVE ARREST Abstract: The purpose of this paper is to study the discourse used in judicial proceedings involving female offenders arrested who have or have not obtained the benefit of house arrest through Article 318 of Law 3689/41 of the Brazilian Code of Criminal Procedure (CPP). We aim to present how entextualization (Bauman and Briggs, 1990) is linked to the co-production of texts and contexts in processes that involve such situation and the possible ways is studying discursive analysis as social practice and applied to legal-institutional language. According to Andrus (2011), texts cannot be isolated and situated within a context without changing both the text that is recontextualized and the context. This analysis has as a methodological basis the Critical Discourse Analysis (ADC) with the objective of analyzing the narratives and texts co-produced in the course of the judicial process by the most diverse actors involved in the social scene in question, who are led and influenced by the institutional legal discourse. Entextualization is part of legal and judicial contexts in which speech originally produced in a situation will be written, summarized, reformulated and reframed by participants not directly engaged in the original "speech" (Erlich, 2007). Thus, we seek to investigate in what way discourses are co-constructed by the defendants and professionals of the area, interpreted, retextualized and entextualized until the sentence. The process of co-construction of this social interaction through narratives, more specifically the speech of the defendants in the processes to be analyzed, seems to be crucial and pertinent in the judgment of these actions. The understanding of narrative as a social discursive-interactive practice organizes human experience and constructs culturally relevant senses. In this sense, we will take as theoretical basis the Narrative Analysis. We also seek to bring reflections of Forensic Linguistics in order to engage this area of linguistics with professional and institutional interactions in legal contexts. Key words: Critical Discourse Analysis (ADC), Narrative Analysis, Entextualization, Sociointeractionism, institutional legal discourse.
